Changes in the anti-corruption legislation of the Republic of Kazakhstan

The compliance service of JSC "NC "Kazakhstan Engineering" informs about the innovations introduced into the anti-corruption legislation of the Republic of Kazakhstan.

The introduced amendments will ensure the reduction of corruption as a negative factor for the socio-economic development of the state, the increase in the activity of civil society in combating corruption, the formation of an anti-corruption culture and the creation of intolerance towards corruption in society.

Main changes:

  • Minimization of manifestations of corruption through preventive measures to control unjust enrichment by persons authorized to perform state functions and equated to them;
  • Responsibility for civil servants for discrepancies in declarations between income and expenses;
  • Ensuring adequate protection of whistle-blowers, including through guarantees against infringement of their labor rights and confidentiality of the information provided;
  • Until January 1, 2025, the rules for publishing on the official Internet resource of the organization the information indicated in the declarations of persons exercising managerial functions in the subjects of the quasi-public sector are suspended;
  • In the subjects of the quasi-public sector, it will be possible to determine the responsible person performing the functions of the anti-corruption compliance service; 
  • The Anti-Corruption Agency of the Republic of Kazakhstan (hereinafter referred to as the Agency) developed and approved the Standard Regulation on anti-corruption compliance services in the subjects of the quasi-public sector (Order of the Chairman of the Agency dated March 31, 2023, No. 112);
  • The coordination by the Agency of the activities of anti-corruption compliance services in the subjects of the quasi-public sector is indicated only in the framework of methodological support, training events and the exchange of information on combating corruption in the subjects of the quasi-public sector.
